Terms of Service
Terms governing VideoCutout accounts, video processing, credits, subscriptions, and acceptable use.
1. Acceptance
These Terms of Service ("Terms") govern your access to and use of VideoCutout at videocutout.net. By creating an account, uploading media, purchasing a product, or using the service, you agree to these Terms, our Privacy Policy, Refund Policy, and Acceptable Use Policy.
You must be at least 18 years old and legally able to enter into these Terms.
2. Service
VideoCutout is an independent web-based SaaS that uses third-party infrastructure and AI models to remove or reconstruct selected areas in videos supplied by users. Results are probabilistic and may contain artifacts, omissions, or unexpected changes. You are responsible for reviewing results before publishing or relying on them.
We may improve, limit, suspend, or discontinue features. We will provide reasonable notice when practicable if a material change affects a paid service.
3. Accounts
You must provide accurate information, protect your credentials, and promptly notify support@videocutout.net of suspected unauthorized access. You are responsible for activity performed through your account.
4. Your Media and Permissions
You retain ownership of the media you submit. You grant us and our service providers a limited right to host, transmit, process, and delete that material solely to provide, secure, and improve the requested service.
You represent that you own the submitted media or have all permissions needed to edit it and provide it to our processors. You must not use VideoCutout to remove third-party ownership, copyright, stock-library, platform, or rights-management marks without authorization.
5. Acceptable Use
You must comply with our Acceptable Use Policy. In particular, VideoCutout may not be used for NSFW or sexually exploitative content, face swaps, deepfakes, impersonation, unlawful surveillance, harassment, fraud, rights infringement, or other harmful or illegal activity.
We may validate media, block requests, remove content, restrict features, suspend accounts, and preserve evidence where reasonably necessary to enforce these rules or comply with law.
6. Credits and Processing
Pricing and processing limits are shown before purchase. Unless stated otherwise, one credit represents one billable second and each task is rounded up to the next five-second unit. Credits may have an expiration date and have no cash value. Failed or timed-out tasks are eligible for automatic credit restoration when our systems confirm the failure.
Processing time and output quality vary with video length, motion, occlusion, model availability, and other factors. A completed task does not guarantee that every requested object was removed perfectly.
7. Payments, Tax, and Receipts
Creem acts as Merchant of Record for purchases made through Creem checkout. Creem processes payment, calculates and remits applicable indirect taxes, and issues the customer receipt or invoice. We do not collect full card details or issue a separate tax invoice for those transactions.
Prices may be displayed exclusive or inclusive of tax depending on location and checkout presentation. You are responsible for providing accurate billing information.
8. Subscriptions and Cancellation
Subscriptions renew automatically at the displayed interval until canceled. You may cancel from Settings → Plans & Billing. Unless the checkout or applicable law states otherwise, cancellation stops future renewals and access continues through the paid period. Cancellation does not itself create a refund.
9. Refunds
Refund eligibility and request instructions are described in our Refund Policy. Nothing in that policy limits non-waivable consumer rights.
10. Intellectual Property
The VideoCutout software, interface, branding, documentation, and original site content are owned by us or our licensors. These Terms do not transfer our intellectual property to you. Third-party names and marks remain the property of their owners; VideoCutout is not endorsed by them unless explicitly stated.
11. Suspension and Termination
You may stop using the service at any time. We may restrict or terminate access for material breach, unlawful or high-risk activity, payment fraud, attacks on the service, or repeated policy violations. Where appropriate, we may provide notice and an opportunity to appeal.
12. Disclaimers
To the extent permitted by law, the service is provided "as is" and "as available." We do not guarantee uninterrupted availability, a particular editing outcome, or fitness for a specific professional, legal, or commercial purpose.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, or claims arising from media you were not authorized to process. Our aggregate liability for a claim will not exceed the amount you paid for the affected service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
14. Changes
We may update these Terms as the service or legal requirements change. We will update the date above and provide additional notice for material changes when reasonably practicable.
